These Terms of Service govern your use of the FaceGym mobile application developed by Forthright Tech LLC.

1. Acceptance of Terms

By downloading, installing, or using the FaceGym application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Forthright Tech LLC ("Company," "we," "us," or "our").

2. Description of Service

FaceGym is a facial fitness application that provides guided exercises for facial muscles using your iPhone's TrueDepth camera technology. The App offers:

  • Real-time facial exercise guidance and feedback
  • Pre-designed workout routines for different skill levels
  • Progress tracking and analytics (stored locally on your device)
  • Educational content about facial fitness
  • Completely offline functionality with no data transmission

3. System Requirements and Compatibility

Device Requirements

  • Device: iPhone X or later with TrueDepth camera
  • Operating System: iOS 15.0 or later
  • Storage: Minimum 50MB available space
  • Camera: Front-facing TrueDepth camera access required

The App will not function properly on devices that do not meet these requirements. We are not responsible for compatibility issues on unsupported devices.

4. Camera and Facial Recognition

Camera Usage

FaceGym requires access to your device's front-facing camera to provide facial exercise feedback. By using the App, you understand and agree that:

  • Camera data is processed in real-time only and never stored or transmitted
  • All facial recognition processing occurs locally on your device
  • No photos, videos, or biometric data are captured or saved
  • You are responsible for ensuring proper lighting and camera positioning
  • Camera access can be revoked at any time through iOS Settings

5. User Responsibilities and Conduct

Acceptable Use

You agree to use FaceGym only for its intended purpose and in accordance with these Terms. You may not:

  • Reverse engineer, decompile, or disassemble the App
  • Attempt to extract source code or proprietary algorithms
  • Use the App for any unlawful or prohibited activities
  • Interfere with or disrupt the App's functionality
  • Create derivative works based on the App
  • Remove or modify any copyright, trademark, or proprietary notices

6. Health and Safety Disclaimers

Medical Disclaimer: FaceGym is designed for general fitness and wellness purposes only. It is not intended to diagnose, treat, cure, or prevent any medical condition.

Consult Healthcare Providers: Before using FaceGym, especially if you have facial injuries, recent cosmetic procedures, TMJ disorders, or any medical conditions affecting your face or jaw, consult with a qualified healthcare provider.

Stop if Experiencing Pain: Discontinue use immediately if you experience pain, discomfort, or any adverse effects. Seek medical attention if symptoms persist.

Age Restrictions: FaceGym is intended for users 13 years and older. Users under 18 should have parental supervision.

7. Intellectual Property Rights

Ownership

The FaceGym application and all related content, including but not limited to software code, exercise routines, user interface design, graphics, text, and proprietary algorithms, are owned by Forthright Tech LLC and protected by intellectual property laws.

Your purchase or download of the App grants you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. App Store Terms

FaceGym is distributed through the Apple App Store. Your use of the App is also subject to Apple's Terms of Service and App Store Review Guidelines. In case of any conflict between these Terms and Apple's terms, Apple's terms will prevail for App Store-related matters.

Apple is not responsible for the App's functionality, support, or any issues arising from its use.

9. Privacy and Data Protection

FaceGym is designed with privacy by default. We do not collect, store, or transmit any personal data. All app functionality operates locally on your device.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Forthright Tech LLC shall not be liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid for the App (if any)
  • We provide the App "as is" without warranties of any kind, express or implied
  • We do not guarantee the App will be error-free or continuously available
  • You assume all risks associated with the use of facial exercise routines

11. Indemnification

You agree to indemnify and hold harmless Forthright Tech LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or any health issues resulting from facial exercises.

12. Updates and Modifications

App Updates

We may provide updates to improve functionality, fix bugs, or add new features. Updates may be automatically downloaded and installed through the App Store.

Terms Updates

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new "Last Updated" date. Continued use of the App constitutes acceptance of updated Terms.

13. Termination

By You: You may stop using the App at any time by deleting it from your device.

By Us: We may discontinue the App or terminate your access if you violate these Terms.

Upon termination, your license to use the App immediately ends, and you must delete all copies from your devices.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
